{"id":2609,"date":"2022-04-30T12:43:29","date_gmt":"2022-04-30T10:43:29","guid":{"rendered":"https:\/\/up-dev.ovh\/?page_id=2609"},"modified":"2025-12-16T11:53:46","modified_gmt":"2025-12-16T10:53:46","slug":"terms-and-conditions-of-sale","status":"publish","type":"page","link":"https:\/\/www.ultimateprovence.com\/en\/conditions-generales-de-vente\/","title":{"rendered":"Terms &amp; Conditions"},"content":{"rendered":"<div data-elementor-type=\"wp-page\" data-elementor-id=\"2609\" class=\"elementor elementor-2609\" data-elementor-post-type=\"page\">\n\t\t\t\t<div class=\"elementor-element elementor-element-29551a64 e-flex e-con-boxed e-con e-parent\" data-id=\"29551a64\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;ekit_has_onepagescroll_dot&quot;:&quot;yes&quot;}\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-5469f4d6 elementor-widget elementor-widget-text-editor\" data-id=\"5469f4d6\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;ekit_we_effect_on&quot;:&quot;none&quot;}\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Effective date: June 01, 2024<br \/>The customer is strongly advised to carefully read the entirety of these general terms and conditions of sale, which apply to all reservations of SAS Domaines de Provence services.<\/p><h2>PREAMBLE<\/h2><p>DOMAINES DE PROVENCE is a simplified joint stock company with a capital of 250,000 euros, whose registered office is located at Ch\u00e2teau de Berne, chemin des Imberts 83780 FLAYOSC, registered in the Draguignan Trade and Companies Register under SIREN number 817 472 954, and whose intra-community VAT number is FR78817472954 (hereinafter DOMAINES DE PROVENCE).<br \/>DOMAINES DE PROVENCE offers hotel services, bed and breakfast services, g\u00eetes and complementary services at various establishments: Le Ch\u00e2teau de Berne (chemin des imberts 83780 FLAYOSC), le Ch\u00e2teau Saint Roux (route de la Garde Freinet 83340 le Cannet-Des-Maures), la Bastide des Bertrands (route de la garde Freinet 83340 le Cannet-Des-Maures), l'Hostellerie de l'Abbaye (57 rue Claudius Camail, 83340 Le Thoronet) and Etablissement Ultimate Provence (7270 route du Luc 83340 la Garde-Freinet) (together hereinafter referred to as \u00abthe Establishment(s)\u00bb and each individually as \u00abthe Establishment\u2019).<\/p><p>The purpose of these General Conditions is to define the terms and conditions under which the establishments of the Soci\u00e9t\u00e9 DOMAINE DE PROVENCE (hereinafter referred to as \"the Company\") allow their customers (hereinafter referred to as \"the Customer(s)\") to benefit from all the services, in particular reservations, available on :<\/p><ul><li>each of the Internet sites of the Company's Establishments, each of the Internet sites being operated by the companies designated in the legal notice of each site, hereinafter referred to as \"the Site(s)\";<\/li><li>by telephone to the reservation department of each establishment, whose contact details are indicated on each website, or to the Company's reservation department;<\/li><li>by telephone to the reservation department of each establishment, whose contact details are indicated on each website;<\/li><li>on site at the reception desk of each Company facility;<\/li><li>through agencies and partners selected by the Company's establishments.<\/li><\/ul><h2>I. GENERAL PROVISIONS<\/h2><p>The Customer is invited to carefully read the present General Conditions, which must be accepted before booking any service offered on the Site. Customers are advised to save and print these General Conditions using the standard functions of their browser and computer. It is also the Customer's responsibility to consult the Conditions of Sale for the fare selected, which are specific to each of the Company's establishments and to the fare selected, before validating the reservation.<\/p><p>The General Terms and Conditions are supplemented by the \"Legal Notices\" of the Websites, by the \"Privacy Policy\" and by the \"Cookie Management\", available on the Websites of the Company's Establishments.<\/p><p>For all other booking methods, the customer receives the general sales conditions with the booking confirmation. Confirmation of a reservation implies acceptance of these conditions and full and unreserved acceptance of their stipulations.<\/p><p>The Company, acting on its behalf, reserves the right to modify or supplement, at any time, all or part of these General Terms and Conditions. In this case, the new version of the General Terms and Conditions will be available on the Sites with its effective date. Customers are advised to consult the General Terms and Conditions regularly to take note of any changes. In any event, the Customer will only be bound by the version of the General Terms and Conditions in force at the time the Customer books the service.<\/p><p>The Company is not liable for damages of any kind that may result from these changes and\/or from the temporary unavailability or permanent closure of all or part of the Site or its associated services, such as the online reservation area, the private area, or the unavailability of the reservation service for the Company's establishments.<\/p><p>The Sites contain the following information:<\/p><ul><li>Legal notices allowing precise identification of the company publishing the Site;<\/li><li>The e-mail address and telephone number used to contact the Company's Establishments;<\/li><li>The essential characteristics of the accommodation offered by the Company's establishments ;<\/li><li>The essential characteristics of the additional and optional services offered;<\/li><li>The present General Conditions.<\/li><\/ul><p>The following information appears on the Sites' booking engines:<\/p><ul><li>Prices include all taxes;<\/li><li>All additional fees applicable to the Services offered on the Sites ;<\/li><li>How the price is determined when it cannot be calculated in advance;<\/li><li>Terms and conditions of sale for the selected fare;<\/li><li>The validity period and price of bids.<\/li><li>Payment terms ;<\/li><li>The present General Conditions.<\/li><\/ul><p><span style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight ); text-align: var(--text-align); font-size: 1rem;\">\u00a0<\/span><\/p><p><span style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight ); text-align: var(--text-align); font-size: 1rem;\">Prior to booking, the Customer declares that this booking is made for his\/her personal needs. The Customer, as a consumer, has specific rights, which would be called into question if the Services booked were not for personal use.<\/span><\/p><p>All information provided on the Site(s) is presented in both French and English.<br \/>The Customer declares that he\/she has full legal capacity to enter into the present Terms and Conditions.<\/p><h2>II. PURPOSE<\/h2><p>These General Terms and Conditions define the rights and obligations of the Customer and the Company operating a Company Establishment for all types of reservations (including remote reservations) for services offered by Company Establishments.<br \/>They govern all the steps necessary for the reservation and the follow-up of the reservation between the contracting parties.<br \/>The Customer acknowledges having read and accepted these General Terms and Conditions of Sale and the Terms and Conditions of Sale of the reserved fare.<\/p><h2>III. DESCRIPTION OF SERVICES<\/h2><p>The Company offers reservation services for hotel rooms, guest rooms, g\u00eetes, suites, ch\u00e2teaux, villas, bastides, or other types of accommodation (hereinafter \"Accommodation Services\"), and services complementary to the said Accommodation Services (hereinafter such as reservation services, catering, wellness and care services etc. (hereinafter the \"Complementary Services\", together with the Accommodation Services, hereinafter the \"Services\"), which may be provided by the Establishments or by external service providers partnering with the Company and offering Services within the Establishments (hereinafter the \"Partners\").<\/p><p>The Company reserves the right to modify or delete, at any time, all or part of the Services offered, and to change Partners. The Company shall not be liable for any damages of any kind that may result from any modification or deletion of the Services offered, and\/or from any change of Partners.<\/p><h3>Accommodation services<\/h3><p>The Company offers Accommodation Services, the main features of which are specified on the Establishments' Internet Site, during the booking process, including but not limited to: description of the Services and the Establishments, details of the room or suite, dates of availability, price, options offered, payment terms and conditions of sale applicable to the rate applied (cancellation conditions, arrival and departure times, number of people).<\/p><p>The specific conditions for reserving the Lodging Service are detailed in the Tariff Sales Conditions. In addition, each of the Company's establishments has its own rules and regulations or room directory (hereinafter referred to as the \"Compendium\") detailing, in particular, check-in and check-out times, cancellation deadlines, Wi-Fi access, specific conditions applicable to minors, and conditions of non-admissibility or admissibility of pets, where applicable, in the rooms and\/or common areas of the Establishments. The Terms and Conditions of Sale are brought to the Customer's attention before any booking confirmation and payment validation, and appear in the booking summary. The Compendium is available in the rooms and at the reception desk of each establishment, and is communicated to the Customer on request.<\/p><p>Minors may only stay in one of our establishments if accompanied by an adult in possession of personal identification. If the accompanying person is an adult other than a legal representative, the latter must be in possession of a parental authorization from the minor's legal representative, accompanied by a copy of the identity document of the minor's legal representative who issued the certificate. The Establishments may, at any time, request a copy of these documents.<\/p><p>No minor may stay or move around the Facilities alone, or benefit from Complementary Services without the presence of an adult. The Customer chooses between the Accommodation Services according to his own needs; he is solely responsible for his choice and their suitability to his needs, such that the Company or the Facilities cannot be held liable in this respect.<\/p><h3>Additional Services<\/h3><p>The Company also offers Complementary Services, the main features of which are specified on the Establishments' Internet Site, for each of the Establishments concerned, during the reservation process, including but not limited to: the description of the Complementary Services, the times of the Complementary Services, the conditions of reservation and access to the Complementary Services, and the prices of the Complementary Services.<\/p><p>The Customer chooses between the Complementary Services according to his own needs; he is solely responsible for his choice and their suitability to his needs, such that the Company or the Establishments cannot be held liable in this respect.<\/p><h3>Service Providers<\/h3><p>The Company may also offer Complementary Services provided by Service Providers who have entered into a service contract or partnership agreement with DOMAINES DE PROVENCE, and who offer their services within the Establishments (the \"Service Providers' Services\"). The Customer may reserve these Service Providers' Services on the Internet Site of the Establishments, by telephone at the reception desk of the Establishments concerned, by means of the contact form available on the Internet Site of the Establishments and\/or, where applicable, on the Internet site of the Service Provider referred to on the Internet Site of the Establishments, or by exchanging e-mails. The specific terms and conditions of Provider Services are described on the Establishments' Website, or on the Provider's website, to which reference is made on the Establishments' Website.<\/p><p>The Customer chooses between the Services of the Providers according to his own needs; he is solely responsible for his choice and their suitability to his needs, such that the Company or the Establishments cannot be held liable in this respect.<br \/>The Company may not, under any circumstances, be held liable for the quality, modification or deletion of a Service Provider or for a change in Partners.<\/p><h2>IV. RESERVATION<\/h2><p>The customer chooses services from among those offered by the Company's establishments according to his needs.<br \/>The Customer acknowledges that he\/she has taken cognizance of the nature, price, destination and booking terms of the services available and has requested and obtained the necessary and\/or additional information, in particular the Conditions of Sale for the fare booked, in order to make his\/her booking with full knowledge of the facts.<\/p><p>The Customer may reserve, on an individual basis, a maximum number of rooms per booking on the Sites. Please note that the maximum number of rooms that can be booked individually varies from one Site to another and is specified in the Compendium of each Site. For reservations of a greater number of rooms, the customer may: contact the sales team by sending an e-mail to the single contact person dedicated to the organization of group events, whose contact details are given in the tab entitled \"Receptions &amp; Seminars\" or \"Reception and Seminar\" depending on the Site of each Hotel, or call this same single contact person, or send a request for a quotation specifying the details of the services he\/she wishes to reserve.<\/p><p>The Customer chooses between services according to his own needs; he is solely responsible for his choice and for their suitability to his needs, such that the Company or the Establishments cannot be held liable in this respect.<br \/>The reservation is deemed accepted by the customer at the end of the reservation process.<br \/>All reservations are nominative and may under no circumstances be transferred to a third party, whether free of charge or in return for payment. Any reservation made for a third party must be made in the name of the third party.<\/p><h2>V. RESERVATION PROCESS<\/h2><h3>Booking Services :<\/h3><p>Reservations made by the Customer can be made directly online via the booking engine on the Site of each Establishment, by telephone to the contact details indicated on the Site of each Establishment, via the contact form available on the Site of each Establishment, with the Partners and\/or on their websites or with partner travel agencies.<br \/>The reservation request is confirmed upon receipt by the Customer of the reservation confirmation sent by one of the Company's establishments.<br \/>Prior to any reservation, the customer undertakes to complete the mandatory information requested when creating the reservation file.<br \/>Failure to provide information identified as mandatory may result in the Company's inability to register a reservation or handle claims. The customer attests to the truthfulness and accuracy of the information provided during the booking process.<br \/>The reservation procedure includes the following steps:<\/p><ul><li>Step 1 - Search for a hotel among the Company's various hotels or directly on the hotel's website, choose the type of room and Conditions of sale for the rate booked,<\/li><li>Step 2 - Selection of one or more Complementary Services,<\/li><li>Step 3 - Presentation of the booking summary, total price, additional charges and taxes, terms and conditions of sale for the rate booked, including payment and cancellation conditions, any necessary changes to the choice of services (date, room, rate, additional service), and information on tourist tax, service charges, credit card charges and employee contribution,<\/li><li>Step 4 - Communication of contact details by the customer,<\/li><li>Step 5 - Terms and Conditions and Privacy Policy :<\/li><\/ul><p>On the Site, the Customer confirms, by ticking the box, that he\/she has read and accepted these General Terms and Conditions of Sale, the Terms and Conditions of Sale for the fare booked and the Privacy Policy before definitively confirming his\/her reservation; no reservation is possible without this agreement.<br \/>For all other booking methods, the customer receives the General Sales Conditions with the booking confirmation. Confirmation of a reservation implies acceptance of these General Terms and Conditions of Sale and full and unreserved acceptance of their provisions.<\/p><ul><li>Step 6 - Finalization of the reservation(s) by the Customer, with communication of the means of payment,<\/li><li>Step 7 - Redirection to the Lyra payment service provider's website and communication of credit card numbers in the event of a guarantee or prepayment request,<\/li><li>Step 8 - Confirmation and validation of reservation and payment by the Customer. Entering the bank details constitutes the Customer's acceptance of the booking and has the effect of contractually binding the Customer to the selected Company establishment.<\/li><li>Step 9 - The customer receives a booking confirmation e-mail and a payment receipt. This e-mail summarizes the reservation date, the services booked, the prices including VAT and details of applicable taxes and surcharges, the Conditions of Sale for the rate booked (including cancellation conditions), accepted by the Customer, the General Terms and Conditions of Sale, and the address of the establishment booked. The Customer is invited to keep his\/her payment receipt and all related e-mails.<\/li><\/ul><p>If the confirmation e-mail or payment receipt is not received within 24 hours of booking, it is the Customer's responsibility to contact the selected Company establishment to ensure that the information provided is correct and that the booking has been taken into account.<\/p><h3>Booking Partner Services :<\/h3><p>Reservations for Partner Services are made directly with each Partner, under the conditions detailed on the Site of the Establishments or on the Internet site of the Partner referred to on the Site of the Establishments concerned.<br \/>The Company and the Establishments where the Partner Service is performed remain third parties to the existing contractual relationship between the Customer and the Partner.<\/p><h3>Bookings through the Company's travel agency partners:<\/h3><p>Services may be booked through the Company's partner travel agencies, which will contact the relevant Establishment directly. The travel agency will provide the Establishment with the information required for the booking process described in the above articles. The Establishment concerned will send a payment link to the partner travel agency and\/or to the Customer, as the case may be, to validate and confirm the booking.<br \/>Under no circumstances may the Company be held liable for any error made by the travel agency in the booking.<\/p><h2>VI. CANCELLATION OR MODIFICATION<\/h2><h3>On the customer's initiative :<\/h3><p>In accordance with article L. 221-28, 12\u00b0 of the French Consumer Code, customers are reminded that they do not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code.<br \/>The Conditions of Sale for the fare booked and accepted by the Customer specify the terms and conditions for cancelling and\/or modifying the booking. Reservations with prepayment for a non-refundable and non-cancellable fare cannot be modified and\/or cancelled.<br \/>In the case of pre-payment bookings for a non-refundable, non-cancellable rate, no refund will be made for interrupted stays.<br \/>When the conditions of sale of the reserved fare permit:<\/p><ul><li>Reservations made on the Site may be cancelled either directly on the Site via the \"Reservation\" section, or with the selected establishment. Reservations made via the Site of one of the Establishments can only be cancelled with the said Establishment.<\/li><li>Changes to the reservation can be made directly with the selected Company establishment, whose telephone number is specified on the confirmation e-mail received by the Customer.<\/li><li>In the event of a no-show, i.e. a reservation that has not been cancelled but for which the customer has not shown up at the Company's establishment on the reserved day, and insofar as the reservation has been guaranteed by credit card or prepaid, the reserved establishment will debit, by way of compensation, the sum of one night reserved, or will not refund the sum paid by way of prepayment in accordance with article 1590 of the French Civil Code. If more than one night is booked, the cancellation conditions will apply in accordance with the Conditions of Sale of the rate booked.<\/li><\/ul><p>In the event of cancellation within the period and under the conditions specified on the booking summary and in the fare Sales Conditions, the price of the Service may be refunded in full to the Customer.<br \/>In the event of interruption of a Service by the Customer during the Service, no refund or compensation will be made for the part of the Service not carried out due to the interruption requested by the Customer.<\/p><h3>At the initiative of one of the Establishments :<\/h3><p>In the event of an exceptional event or the impossibility of making the type of room reserved available to the Customer, or in the event of force majeure, the Company's establishment reserved may offer the Customer an accommodation solution in an establishment of at least equivalent category, or if it is of a lower category, a room of a higher standard than that originally reserved, for services of the same nature. In the event of non-acceptance of the proposed alternative solution, the Customer is free to request cancellation of the Service booked, in return for reimbursement of all sums paid by the Customer for the booking of the cancelled Service.<\/p><h2>VII. COMMITMENTS AND RESPONSIBILITIES OF THE CUSTOMER<\/h2><p>All guests staying at the establishment must be able to present valid identification upon check-in. Failure to do so may result in the Company's establishment refusing to rent the room and\/or cancelling the reservation, without the possibility of reimbursement.<br \/>La client\u00e8le \u00e9trang\u00e8re, y compris les accompagnants et les adolescents de plus de 15 ans, devront obligatoirement remplir une \u00ab fiche individuelle de police \u00bb. Les enfants de moins de quinze ans pourront figurer sur la fiche d\u2019un adulte qui les accompagne. Les informations contenues dans celles-ci sont encadr\u00e9es par les articles R.814-1 \u00e0 R.814-3 du Code de l\u2019entr\u00e9e et du s\u00e9jour des \u00e9trangers et du droit d\u2019asile.<br \/>Le client ne peut introduire dans la chambre des tierces personnes qu\u2019apr\u00e8s avoir sollicit\u00e9 l\u2019autorisation expresse de l\u2019Etablissement de la Soci\u00e9t\u00e9 qui se r\u00e9serve le droit d\u2019effectuer toutes les v\u00e9rifications n\u00e9cessaires et de facturer d\u2019\u00e9ventuels suppl\u00e9ments.<br \/>Nous accueillons bien volontiers les chiens \u00e0 condition qu\u2019ils soient tenus en laisse dans toutes les parties communes de l\u2019\u00e9tablissement, \u00e9tant pr\u00e9cis\u00e9 que l\u2019Etablissement de la Soci\u00e9t\u00e9 peut refuser d\u2019accueillir tout animal de compagnie ou autre susceptible de pr\u00e9senter un risque de s\u00e9curit\u00e9 pour les autres occupants, l\u2019appr\u00e9ciation de ce risque \u00e9tant laiss\u00e9e \u00e0 la discr\u00e9tion des Etablissements de la Soci\u00e9t\u00e9. Pour des raisons d\u2019hygi\u00e8ne, les animaux ne sont pas admis dans les espaces de restauration ni aux abords des piscines, espaces fitness, spa et espace de bien \u00eatre (ces dispositions ne s\u2019appliquent pas aux chiens guide d\u2019aveugle ou d\u2019assistance). Afin de garantir la tranquillit\u00e9 de chacun, les animaux ne doivent pas \u00eatre laiss\u00e9s seuls sans surveillance. Un suppl\u00e9ment tarifaire par animal pourra vous \u00eatre factur\u00e9, nous vous invitons \u00e0 vous reporter aux conditions particuli\u00e8res de chaque Etablissement sur le Site pour conna\u00eetre les modalit\u00e9s d\u2019acceptation.<br \/>Les Etablissements de la Soci\u00e9t\u00e9 se r\u00e9servent la possibilit\u00e9 de ne pas recevoir ou d\u2019expulser, sans remboursement, les Clients dont la tenue est ind\u00e9cente et n\u00e9glig\u00e9e, dont la tenue est destin\u00e9e \u00e0 dissimuler le visage (Loi N\u00b02010-1192 du 11 octobre 2010), les Clients ayant un comportement bruyant, incorrect ou alcoolis\u00e9, les Clients dont le comportement est contraire \u00e0 l\u2019hygi\u00e8ne, aux bonnes m\u0153urs et \u00e0 l\u2019ordre public. Une tenue correcte est exig\u00e9e aux restaurants et dans les espaces publics de chaque Etablissement.<br \/>Le Client est courtois et respectueux vis-\u00e0-vis du personnel de chaque Etablissement. A peine d\u2019exclusion sans remboursement, le Client s\u2019abstient \u00e0 son \u00e9gard de toute violence verbale ou physique, de tout comportement ou propos raciste ainsi que de toute forme de harc\u00e8lement.<br \/>Le Client accepte de ne pas utiliser les ressources informatiques mises \u00e0 sa disposition au sein des Etablissements (notamment le r\u00e9seau Internet Wifi), \u00e0 l\u2019effet d\u2019enfreindre la r\u00e9glementation applicable.<br \/>Afin de respecter la vie priv\u00e9e et le droit \u00e0 l\u2019image des autres clients d\u2019un Etablissement de la Soci\u00e9t\u00e9, le Client s\u2019interdit de les prendre en photographie dans l\u2019enceinte de l\u2019Etablissement ou de ses d\u00e9pendances et\/ou de publier les photographies prises dans de telles conditions.<br \/>Le Client accepte et s\u2019engage \u00e0 utiliser la chambre ainsi que les espaces communs mis \u00e0 sa disposition, de mani\u00e8re raisonnable. Tout d\u00e9g\u00e2t occasionn\u00e9 par le Client ou par les occupants de son fait dans la chambre ou dans les diff\u00e9rents espaces occup\u00e9s par lui au cours de son s\u00e9jour, doit \u00eatre signal\u00e9 \u00e0 la r\u00e9ception de l\u2019Etablissement et pourra lui \u00eatre directement factur\u00e9 \u00e0 hauteur des frais de remise en \u00e9tat.<br \/>Pour des raisons de s\u00e9curit\u00e9 et pour le respect de chacun, il est formellement interdit de fumer dans l\u2019enceinte de l\u2019Etablissement. Conform\u00e9ment au Code de la sant\u00e9 public dans ses dispositions fixant les conditions d\u2019application de l\u2019interdiction de fumer dans les lieux affect\u00e9s \u00e0 un usage collectif, fumer dans l\u2019Etablissement expose le client \u00e0 l\u2019amende pr\u00e9vue pour les contraventions de la troisi\u00e8me classe ou \u00e0 des poursuites judiciaires.<br \/>Le client pourrait se voir imposer une p\u00e9nalit\u00e9 allant jusqu\u2019\u00e0 2 000 euros s\u2019il ne respecte pas l\u2019affichage prescrivant l\u2019interdiction de fumer dans sa chambre.<br \/>Sauf disposition expresse contraire, le Client doit quitter la chambre avant 11.00 heures le jour de la fin de la r\u00e9servation. A d\u00e9faut, il lui sera factur\u00e9 une nuit\u00e9e suppl\u00e9mentaire.<br \/>Toute r\u00e9servation ou paiement qui seraient irr\u00e9guliers, inop\u00e9rants, incomplets ou frauduleux pour un motif imputable au Client entra\u00eenera l\u2019annulation de la commande aux frais du Client, sans pr\u00e9judice de toute action civile ou p\u00e9nale \u00e0 l\u2019encontre d\u2019un des Etablissements de la Soci\u00e9t\u00e9.<\/p><h2>VIII. ENGAGEMENTS ET RESPONSABILITES DES ETABLISSEMENTS DE LA SOCI\u00c9T\u00c9<\/h2><p>Les Etablissements de la Soci\u00e9t\u00e9 sont tenus de la garantie de conformit\u00e9 des Services, dans les conditions des articles L. 217-1 et suivants du Code de la consommation.<br \/>La Soci\u00e9t\u00e9 s\u2019engage, dans le cadre d\u2019une obligation de moyens, \u00e0 fournir un acc\u00e8s aux Etablissements et aux Services propos\u00e9s en respectant les Conditions G\u00e9n\u00e9rales, et \u00e0 agir avec diligence et comp\u00e9tence et mettre tout en \u0153uvre, dans une limite raisonnable, afin de rem\u00e9dier \u00e0 tout trouble ou dysfonctionnement port\u00e9 \u00e0 sa connaissance.<br \/>Les Etablissements de la Soci\u00e9t\u00e9 pourront cependant se trouver dans l\u2019obligation de suspendre momentan\u00e9ment le Service sans pr\u00e9avis, notamment pour des raisons techniques de maintenance ou de s\u00e9curit\u00e9, sans que ceci n\u2019entraine sa responsabilit\u00e9.<br \/>Dans le contexte exceptionnel d\u2019une crise sanitaire ou autre, si des mesures restrictives d\u2019acc\u00e8s voire d\u2019interdiction d\u2019utilisation de certains espaces recevant du public, \u00e9taient prises par les autorit\u00e9s administratives comp\u00e9tentes, le Client est inform\u00e9 que la Soci\u00e9t\u00e9 et les Etablissements concern\u00e9s pourraient restreindre, partiellement ou totalement, l\u2019acc\u00e8s \u00e0 certains Services ou lieux au sein des Etablissements, sans que la responsabilit\u00e9 de la Soci\u00e9t\u00e9 ne puisse \u00eatre recherch\u00e9e. Dans une telle hypoth\u00e8se, la Soci\u00e9t\u00e9 s\u2019engage \u00e0 informer le Client, dans les meilleurs d\u00e9lais, des restrictions mises en \u0153uvre et des cons\u00e9quences sur le Service r\u00e9serv\u00e9. Le Client ne pourra pr\u00e9tendre \u00e0 aucune indemnisation dans de telles circonstances.<br \/>Le Client reconnait et accepte que la responsabilit\u00e9 de la Soci\u00e9t\u00e9 ne saurait \u00eatre engag\u00e9e pour tous les inconv\u00e9nients ou dommages li\u00e9s \u00e0 l\u2019utilisation du r\u00e9seau Internet, dont, sans que cette liste soit limitative :<\/p><ul><li>La mauvaise transmission et\/ou r\u00e9ception de toute donn\u00e9e et\/ou information sur Internet ;<\/li><li>La d\u00e9faillance de tout mat\u00e9riel de r\u00e9ception ou des lignes de communication ; et<\/li><li>Tout dysfonctionnement du r\u00e9seau Internet emp\u00eachant le bon fonctionnement du Site.<\/li><\/ul><p>Les Sites internet des Etablissements peut renvoyer vers des liens hypertextes d\u2019autres sites Internet \u00e9dit\u00e9s et g\u00e9r\u00e9s par des Partenaires pour lequel la Soci\u00e9t\u00e9 d\u00e9gage toute responsabilit\u00e9 quant au contenu de ces sites Internet et aux services qui y sont propos\u00e9s. A cet \u00e9gard, il est pr\u00e9cis\u00e9 que les Partenaires sont responsables de la promotion des offres diffus\u00e9es sur leurs propres sites Internet. La d\u00e9cision de consulter des sites Internet tiers rel\u00e8ve donc de la pleine et enti\u00e8re responsabilit\u00e9 du Client.<br \/>Conform\u00e9ment aux lois et r\u00e8glements r\u00e9gissant les droits de propri\u00e9t\u00e9 intellectuelle, l\u2019utilisation et\/ou la reproduction de tout ou partie des \u00e9l\u00e9ments composant les offres de la Soci\u00e9t\u00e9 pr\u00e9sentes sur le(s) Site(s) sont strictement interdites, de m\u00eame que toute reproduction des d\u00e9cors et\/ou \u00e9l\u00e9ments caract\u00e9ristiques des Etablissements de la Soci\u00e9t\u00e9.<br \/>Les photographies pr\u00e9sent\u00e9es sur le(s) Site(s) ne sont pas contractuelles. M\u00eame si tous les meilleurs efforts sont faits pour que les photographies, repr\u00e9sentations graphiques et les textes reproduits pour illustrer les Etablissements de la Soci\u00e9t\u00e9 pr\u00e9sent\u00e9s, donnent un aper\u00e7u aussi exact que possible des prestations d\u2019h\u00e9bergement propos\u00e9es, des variations peuvent intervenir, notamment en raison du changement de mobilier, de r\u00e9novations \u00e9ventuelles ou encore des ph\u00e9nom\u00e8nes climatiques. Le Client ne peut pr\u00e9tendre \u00e0 aucune r\u00e9clamation de ce fait.<\/p><h2>IX. PRIX ET PAIEMENT<\/h2><h3>Prix :<\/h3><p>Les prix aff\u00e9rents \u00e0 la r\u00e9servation des services sont communiqu\u00e9s avant, pendant et apr\u00e8s la r\u00e9servation.<br \/>Les prix communiqu\u00e9s s\u2019entendent par chambre \/ suite \/ villa pour le nombre de personne(s) et le(s) date(s) s\u00e9lectionn\u00e9e(s). Sauf mention contraire, les services compl\u00e9mentaires (petit d\u00e9jeuner, demi-pension, pension compl\u00e8te\u2026) ne sont pas inclus dans le prix. Lors de la confirmation de la r\u00e9servation du Client, le montant total de la r\u00e9servation de services sera indiqu\u00e9.<br \/>Les prix tiennent compte de la TVA applicable au jour de la r\u00e9servation et tout changement du taux applicable \u00e0 la TVA sera automatiquement r\u00e9percut\u00e9 sur les prix indiqu\u00e9s \u00e0 la date de facturation.<br \/>L\u2019ensemble des frais suppl\u00e9mentaires applicable au tarif s\u00e9lectionn\u00e9 et leur mode de calcul sont explicitement communiqu\u00e9s avant et lors de la r\u00e9servation. Il s\u2019agit de la taxe de s\u00e9jour, de la contribution employ\u00e9s, des frais de service et des frais de r\u00e8glement par carte bancaire lorsqu\u2019ils sont applicables selon les Conditions de vente du tarif.<br \/>Les prix sont confirm\u00e9s au Client toute taxe comprise (TTC), dans la devise commerciale de l\u2019Etablissement (l\u2019Euro). Les prix communiqu\u00e9s ne sont valables que pour une dur\u00e9e d\u00e9termin\u00e9e. Toutes les r\u00e9servations, sont payables dans la monnaie locale de l\u2019Etablissement.<br \/>Si un tarif implique que le paiement doit \u00eatre s\u2019effectu\u00e9 directement \u00e0 l\u2019Etablissement dans une monnaie autre que celle confirm\u00e9e sur la r\u00e9servation, les frais de change (conversion et frais bancaires) sont \u00e0 la charge du Client. A noter que s\u2019il appara\u00eet une conversion de la monnaie confirm\u00e9e sur la r\u00e9servation en une autre monnaie, elle est donn\u00e9e \u00e0 titre purement indicatif et non contractuelle, compte tenu notamment de la possible \u00e9volution des taux de change entre la date de r\u00e9servation et la date de s\u00e9jour \u00e0 l\u2019\u00e9tablissement.<br \/>La taxe de s\u00e9jour, et toute autre taxe sp\u00e9cifique aux communes indiqu\u00e9es pour chaque tarif, est \u00e0 r\u00e9gler directement sur place aupr\u00e8s de l\u2019Etablissement sauf dans le cas d\u2019un pr\u00e9paiement en ligne o\u00f9 ce montant peut \u00eatre inclus.<br \/>Toute modification ou instauration de nouvelles taxes l\u00e9gales ou r\u00e9glementaires impos\u00e9es par les autorit\u00e9s comp\u00e9tentes seront automatiquement r\u00e9percut\u00e9es sur les prix indiqu\u00e9s \u00e0 la date de la facturation. Ces taxes seront communiqu\u00e9es au Client au moment de la r\u00e9servation, si ces derni\u00e8res sont connues de l\u2019Etablissement \u00e0 ce moment-l\u00e0. A d\u00e9faut, elles seront affich\u00e9es \u00e0 la r\u00e9ception de l\u2019Etablissement de la Soci\u00e9t\u00e9 r\u00e9serv\u00e9. Le Client s\u2019engage \u00e0 r\u00e9gler les diff\u00e9rentes taxes, sans contestation aucune aupr\u00e8s de l\u2019Etablissement r\u00e9serv\u00e9.<br \/>Les Etablissements de la Soci\u00e9t\u00e9 garantissent que leurs meilleurs tarifs sont propos\u00e9s sur les Sites. Si apr\u00e8s avoir r\u00e9serv\u00e9 un Etablissement de la Soci\u00e9t\u00e9 sur les Sites, le Client trouve dans les 24 heures suivant sa r\u00e9servation une offre \u00e9quivalente pour la ou les m\u00eames dates, \u00e0 un tarif inf\u00e9rieur pour le m\u00eame Etablissement, le m\u00eame nombre de personnes et le m\u00eame type de chambre, les m\u00eames prestations (petit-d\u00e9jeuner, etc) aux m\u00eames conditions de vente (annulable ou non, remboursable ou non) sur un autre site Internet (hors exclusion), hors taxe de s\u00e9jour mais frais de dossier inclus, les Etablissements de la Soci\u00e9t\u00e9 vous garantissent ce tarif assorti d\u2019un produit additionnel \u00e0 la discr\u00e9tion de l\u2019Etablissement.<\/p><h3>Paiement :<\/h3><p>A la fin du parcours de r\u00e9servation, un lien de paiement sera adress\u00e9 au Client, sur l\u2019adresse \u00e9lectronique renseign\u00e9e pendant le parcours de r\u00e9servation. Les Conditions de vente du tarif de chaque Etablissement d\u00e9taillent les modalit\u00e9s de paiement (montant des arrhes, dates et conditions de r\u00e8glement, et conditions de remboursement), qui peuvent \u00eatre diff\u00e9rentes en fonction des Etablissements concern\u00e9s et des Services r\u00e9serv\u00e9s.<br \/>En cliquant sur le lien de paiement, le Client sera dirig\u00e9 vers le site internet du prestataire de paiement de la Soci\u00e9t\u00e9, Lyra. Ce prestataire utilise un outil de paiement s\u00e9curis\u00e9 par cryptage des coordonn\u00e9es bancaires et est certifi\u00e9 PCI DSS.<br \/>Si le Client utilise le moteur de r\u00e9servation en ligne pour effectuer sa r\u00e9servation, il sera, \u00e0 la fin du parcours de r\u00e9servation, directement dirig\u00e9 vers le site internet du prestataire de paiement Lyra.<br \/>Le Client doit communiquer, pendant le parcours de r\u00e9servation, ses informations de paiement pour valider la r\u00e9servation du ou des Service(s) choisi(s). Les cartes bancaires accept\u00e9es sur le Site Internet des Etablissements sont les suivantes : Visa, Mastercard et American Express. La Soci\u00e9t\u00e9 se r\u00e9serve le droit de modifier cette liste \u00e0 tout moment.<br \/>Le Client communique ses donn\u00e9es de paiement soit pour pr\u00e9payer la r\u00e9servation avant le s\u00e9jour, soit au titre de garantie de la r\u00e9servation en cas de \u00ab non-pr\u00e9sentation \u00bb. Lorsqu\u2019il s\u2019agit d\u2019une carte bancaire, les informations requises sont : le num\u00e9ro de carte bancaire, sans espaces entre les chiffres, le nom du titulaire de la carte, la date de validit\u00e9 (il est pr\u00e9cis\u00e9 que la carte bancaire utilis\u00e9e doit \u00eatre valable au moment du s\u00e9jour) et le cryptogramme visuel dans le cadre d\u2019un pr\u00e9paiement.<br \/>Le partenaire d\u00e9sign\u00e9 effectue des v\u00e9rifications de s\u00e9curit\u00e9 sur la carte de paiement du Client, telles que le contr\u00f4le d\u2019encours, contr\u00f4le du pays de la carte, contr\u00f4le du pays de l\u2019adresse IP. La carte peut \u00eatre refus\u00e9e pour diverses raisons, notamment en cas de vol, de blocage, de d\u00e9passement de plafond, ou d\u2019erreur de saisie etc. Cependant, le paiement doit \u00eatre finalis\u00e9, sans exception, afin de confirmer la r\u00e9servation et il est de la responsabilit\u00e9 du client de s\u2019en assurer.<br \/>En cas de refus de paiement de la banque, la r\u00e9servation sera automatiquement annul\u00e9e. Par ailleurs, toute R\u00e9servation ou paiement qui seraient irr\u00e9guliers, inop\u00e9rants, incomplets ou frauduleux pour un motif imputable au Client entrainera l\u2019annulation de la r\u00e9servation aux frais du Client, sans pr\u00e9judice de toute action que la Soci\u00e9t\u00e9 pourrait intenter \u00e0 l\u2019encontre de ce dernier.<br \/>Dans le cadre de la lutte contre les fraudes sur internet, les informations relatives \u00e0 la r\u00e9servation du Client peuvent \u00eatre transmises \u00e0 tout tiers habilit\u00e9 par la loi ou d\u00e9sign\u00e9 par la Soci\u00e9t\u00e9 aux seules fins de v\u00e9rification de l\u2019identit\u00e9 du Client, de la validit\u00e9 de la r\u00e9servation, et du mode de r\u00e8glement utilis\u00e9. La Soci\u00e9t\u00e9 se r\u00e9serve le droit de demander une photocopie de la carte d\u2019identit\u00e9 du Client et\/ou toute information relative au Client dans le cadre de ce contr\u00f4le.<br \/>Le d\u00e9bit de la carte bancaire renseign\u00e9e est effectu\u00e9 au moment de la validation du paiement, apr\u00e8s confirmation de la banque \u00e9mettrice de la carte. Conform\u00e9ment aux dispositions de l\u2019article L. 132-2 du Code mon\u00e9taire et financier, l\u2019engagement de payer, donn\u00e9 au moyen d\u2019une carte de paiement est irr\u00e9vocable. En cons\u00e9quence, en communiquant les informations relatives \u00e0 sa carte de paiement, le Client autorise la Soci\u00e9t\u00e9, et\/ou les Etablissements \u00e0 d\u00e9biter sa carte de paiement du montant correspondant au prix total, T.T.C, du Service r\u00e9serv\u00e9. Le Client d\u00e9clare qu\u2019il est le titulaire de la carte de paiement renseign\u00e9e, \u00e0 d\u00e9biter, et que le nom figurant sur la carte de paiement est effectivement le sien.<br \/>Le paiement par virement pourra \u00e9galement \u00eatre sollicit\u00e9 par l\u2019Etablissement pour des r\u00e9servations dont le montant est sup\u00e9rieur \u00e0 2 500 euros ou sur demande expresse du client.<br \/>En cas de paiement \u00e0 l\u2019Etablissement, chaque Etablissement de la Soci\u00e9t\u00e9 peut accepter des moyens de paiements diff\u00e9rents mais le Client doit pr\u00e9senter \u00e0 l\u2019Etablissement la carte bancaire lui ayant permis de garantir la r\u00e9servation ou de r\u00e9aliser le pr\u00e9paiement afin de s\u2019assurer de l\u2019identit\u00e9 du Client. L\u2019Etablissement pourra \u00e9galement lui demander de pr\u00e9senter une pi\u00e8ce d\u2019identit\u00e9 \u00e0 des fins de pr\u00e9vention des fraudes \u00e0 la carte bancaire.<br \/>Si le Client n\u2019a pas pr\u00e9pay\u00e9 son s\u00e9jour, l\u2019Etablissement demandera au Client, lors de son arriv\u00e9e, un d\u00e9p\u00f4t de garantie ou une autorisation de d\u00e9biter la carte bancaire en vue de garantir le s\u00e9jour correspondant au montant total des nuit\u00e9es r\u00e9serv\u00e9es augment\u00e9 du montant forfaitaire par personne et par jour, variant selon l\u2019Etablissement, en vue de garantir les \u00e9ventuelles consommations suppl\u00e9mentaires.<br \/>Cette m\u00eame garantie sera exig\u00e9e aupr\u00e8s des tiers invit\u00e9s.<br \/>En cas de non-pr\u00e9sentation, c\u2019est-\u00e0-dire en cas de r\u00e9servation non annul\u00e9e mais pour laquelle le client ne s\u2019est pas pr\u00e9sent\u00e9 \u00e0 l\u2019Etablissement le jour r\u00e9serv\u00e9 et dans la mesure o\u00f9 la r\u00e9servation aura \u00e9t\u00e9 garantie par carte bancaire, l\u2019Etablissement de la Soci\u00e9t\u00e9 r\u00e9serv\u00e9 d\u00e9bitera la somme d\u2019une nuit r\u00e9serv\u00e9e, \u00e0 titre d\u2019indemnit\u00e9 due en raison du pr\u00e9judice subi du fait de la non-pr\u00e9sentation. Si plusieurs nuits \u00e9taient r\u00e9serv\u00e9es, les modalit\u00e9s d\u2019annulation attach\u00e9es au tarif r\u00e9serv\u00e9 s\u2019appliqueraient.<br \/>If the amount due has not been paid by the time of departure, the total amount will be debited from the credit card used as a guarantee.<br \/>In addition, in the event of damage to the room, walls, furniture or equipment caused by the customer, the establishment will inform the customer and charge the cost of cleaning or replacing the damaged equipment to the credit card used as a guarantee.<br \/>For stays of more than one week in one of our establishments, the customer will receive a weekly invoice covering all services, items and consumption over the last seven days.<\/p><h2>X. They are kept for the duration necessary to the commercial relationship established between the customer and the company.<br \/>Certain information requested in the forms is mandatory and is indicated by an asterisk. INTELLECTUAL PROPERTY RIGHTS<\/h2><p>The trademark and logo \"MDCV\", \"Domaines de Provence\", the names of the Establishments and the logos \"Ch\u00e2teau de Berne\" \"Ch\u00e2teau Saint-Roux\", \"Ch\u00e2teau des Bertrands\", \"UP\" \"Ultimate Provence\", as well as all figurative trademarks, and more generally, all illustrations, images, drawings, logotypes appearing and used on the Internet Site of the Establishments belong to the Company, or are used by the Company by virtue of a right of use in force.<br \/>Any total or partial reproduction, modification or use of these trademarks, illustrations, images and logos, for any reason whatsoever and on any medium whatsoever, without the express prior consent of the Company, is strictly prohibited. In particular, the use and reproduction of all or part of the elements of the Services presented on the Etablissements website, as well as the reproduction of the decor of the Houses, are strictly forbidden.<\/p><h2>XIII. FORCE MAJEURE<\/h2><p>The Company shall not be held liable to the Customer in the event of non-performance of its obligations resulting from an event of force majeure.<br \/>Likewise, the Customer shall not be liable to the Company in the event of non-performance of its obligations resulting from an event of force majeure.<br \/>It is expressly agreed that force majeure suspends the parties' performance of their mutual obligations, and that each party shall bear the costs arising therefrom. Force majeure or fortuitous events are those usually recognized by the jurisprudence of the French Courts and Tribunals, including but not limited to: any event of a climatic, bacteriological, military, political, economic, social or computer nature, of such magnitude, beyond the control of the parties, which could not be reasonably foreseen at the time of conclusion and the effects of which cannot be avoided by appropriate measures, preventing performance of a contractual obligation.<br \/>The reserved Establishment may offer the Customer accommodation in an Establishment of at least equivalent category, or if it is of a lower category, a room of a higher level than that originally reserved, for services of the same nature. Any additional costs associated with this relocation, for services of the same nature, will be borne by the establishment originally booked. The customer may also cancel the reservation, in which case a credit note or immediate refund will be issued.<\/p><h2>XIV. INTEGRALITY<\/h2><p>The present General Terms and Conditions of Sale, the conditions of sale of the fare booked by the Customer, and the booking confirmation express the entirety of the obligations of the parties.<br \/>No general or specific conditions communicated by the Customer may be incorporated into these General Terms and Conditions.<br \/>The documents forming the contractual commitments between the parties are, in descending order of priority, the reservation form or request (including the Conditions of Sale for the fare booked), which has been validated by the Customer, and these General Conditions.<br \/>In the event of any contradiction between the booking confirmation and these General Terms and Conditions, the provisions appearing on the booking confirmation shall be the only ones applicable to the obligation in question.<\/p><h2>XV. SETTLEMENT OF DISPUTES<\/h2><p class=\"MsoNormal\">In the event of a dispute relating to these General Conditions<br \/>or any other dispute with an Establishment of the Company the parties<br \/>will endeavour to find an amicable solution.
